Chemical Ingredient Disclosure – New York and California

Per the ingredient communication legislation in California and New York this applies only certain product types, our regulatory conducts a review of product labeling to determine whether it is reportable under the regulation. Covered product types are defined as follow:

The New York bill specifies that Cleansing products include soaps and detergents containing a surfactant as a wetting or dirt emulsifying agent and used primarily for domestic or commercial cleaning purposes, as well as household and commercial premises which include laundries, hospitals and food or restaurant establishments. The program does not cover products labeled, advertised, marketed and distributed for use primarily as pesticides or used primarily in industrial manufacturing, production and assembling processes.

California’s SB258 states that a “designated product” means a finished product that is an air care product, automotive product, general cleaning product, or a polish or floor maintenance product used primarily for janitorial, domestic, or institutional cleaning purposes. However, “designated product” does not mean Industrial products specifically manufactured for and exclusively used in oil, gas, steel or heavy industry manufacturing, Industrial textile maintenance and processing other than industrial laundering and Other industrial manufacturing processes.

Please note for products that are subject to disclosure, New York also requires that a certification form be completed and returned to the NYDEC detailing the products you sell into the state. A copy of this form is available at the NY link above. In addition, requirements for website display and other requirements are given in the regulations.
